Applied Marketing Science, Inc. (AMS) (“AMS,” “we,” “us,” or “our“) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect Personal Information that is collected while providing our services to you (“Services”) and through our Site and online platforms that link to this Notice (“Site”), including when you apply for a job with us. It also describes rights you may have under applicable laws. Please read this Privacy Policy carefully to understand our policies and practices regarding your Personal Information and how we will treat it.  

This Privacy Policy applies to the following individuals:

• Current, former, and prospective clients;

This Privacy Policy does not apply to individuals who participate in surveys, interviews, focus groups, usability studies, or other market research activities conducted by or on behalf of AMS.

The categories of Personal Information we collect may include:  

• Contact Information – If you submit an inquiry, attend a webinar, subscribe to our blog or other marketing materials or otherwise provide information on or through our Site or Services, we may collect your contact information including your name, mailing address, email address, and phone number.  
• Commercial Information – If you submit an inquiry, or provide information on our Site, we may collect commercial information including information about Services you have shown interest in. 
• Usage Information – When you use our Site, we may automatically record information, including your Internet Protocol address (IP Address), geolocation of your device, browser type, referring URLs (e.g., the website you visited before coming to our Site), domain names associated with your internet service provider, and any other information regarding your interaction with our Site. 
• Employment Information – If you apply for employment with us, we will collect Personal Information related to your potential employment, including your education and employment history, address and contact information, demographic information, and any other information included in your resume or application.  
• Communication Information – We may collect Personal Information contained within your communications with us via email, social media, telephone, or otherwise, and in certain cases we may use third-party service providers to do so. Where permitted by applicable law, we may collect and maintain records of calls and chats with our agents, representatives, or employees. 

How We Collect Personal Information  

We may collect Personal Information directly from you, automatically through your use of our Site, and from other sources as described below. 

Information You Voluntarily Provide

We collect information that you choose to provide to us directly, including when you complete a contact form on our Site, request information from us, subscribe to our blog or other marketing materials, or otherwise utilize our Site or Services. 

Information Collected Automatically 

When you visit our Site, we and our service providers may automatically collect certain information about your device and your interactions with our Site and Services. We may collect this information through cookies, pixels, analytics tools, and similar technologies. From Third Parties  

We may collect Personal Information from third parties, including but not limited to business partners, advertising networks, social networks, data analytics providers, mobile device providers, Internet or mobile service providers, recruiters and job application portals, background check providers, and other third parties that help us provide or support our Services.  

How We Use Personal Information 

To the extent permitted by applicable law, we may use Personal Information: 

• To respond to inquiries, requests, and communications submitted through our Site or other channels; 
• To provide Services, information, resources, or other materials that you request; 
• To manage and maintain our relationships with clients, prospective clients, vendors, service providers, and other business contacts; 
• To administer our Site, analyze website usage, improve website functionality, and enhance the user experience; 
• To communicate with you regarding our Services, thought leadership content, events, webinars, newsletters, and other marketing or business development activities, where permitted by applicable law; 
• To evaluate the effectiveness of our marketing, communications, and business development efforts; 
• To protect the security, integrity, and operation of our Site, systems, and business operations; 
• To detect, prevent, investigate, or address fraud, security incidents, unauthorized access, or other unlawful activities; 
• To comply with applicable laws, regulations, legal processes, court orders, or governmental requests; and 
• To establish, exercise, or defend our legal rights and fulfill our contractual obligations. 
• As part of a corporate transaction, such as in connection with the sale of part or all of our assets or business, the acquisition of part or all of another business or another business’ assets, or another corporate transaction, including bankruptcy. 

We may also use Personal Information for other purposes that are disclosed at the time the information is collected or otherwise permitted by applicable law. 

If you are applying for employment with us, we also use Personal Information to process your job application, to verify the information you have provided in your application, conduct interviews, perform background and reference checks, to communicate with you and answer your questions, to confirm your eligibility for employment, and improve our recruiting processes. We may also save your Personal Information for future employment opportunities with us. 

Legal Bases for Processing 

For individuals located in the European Economic Area (EEA), United Kingdom, or other jurisdictions where applicable law requires a legal basis for processing Personal Information, we rely on one or more of the following legal bases:

• Consent: We may process Personal Information based on your consent, such as when you subscribe to marketing communications or where consent is otherwise required by law. You may withdraw your consent at any time, subject to applicable legal or contractual restrictions. 
• Performance of a Contract: We may process Personal Information as necessary to enter into, perform, or manage a contract or business relationship with you or the organization you represent. 
• Legitimate Interests: We may process Personal Information when necessary for our legitimate business interests, provided those interests are not overridden by your rights and interests. Examples include responding to inquiries, managing business relationships, improving our Site and Services, conducting business development activities, protecting our systems and information, and communicating about our Services. 
• Legal Obligations: We may process Personal Information as necessary to comply with applicable laws, regulations, legal processes, court orders, or other legal obligations.

Where required by applicable law, we will identify the specific legal basis upon which we rely when collecting and processing Personal Information. 

We do not intend to collect Special Category Data, such as Personal Information that reveals your racial or ethnic origin, political opinions, religious or philosophical beliefs, or trade union membership. Special Category Data also includes genetic data, biometric data, and information about your sex life or sexual orientation. Please do not send us this type of information unless we specifically request it. 

Cookies and Tracking Technologies 

We and our service providers may use cookies, web beacons, pixels, analytics tools, and similar technologies to collect information about your interactions with our Site and communications. We process the information collected through such technologies, which  may include or be combined with Personal Information. These technologies help us: 

• Operate and maintain our Site; 
• Understand how visitors use our Site; 
• Measure the effectiveness of marketing campaigns and website content; 
• Improve website functionality and user experience; 
• Remember user preferences and settings; and 
• Support our business development and marketing activities. 

Types of Cookies We Use 

Website Delivery and Appearance – We may use third-party providers to enable certain customer interaction opportunities, content delivery (like audio or video), or other service capabilities. Examples include, but are not limited to, the following functionality: 

• Content Delivery: We partner with service providers to host our Site and deliver specific content in support of our Services. For example, we partner with companies like YouTube to deliver specific content, such as audio and video. • Customer Interaction: We enhance our customer interactions by offering features like Google Maps to locate our Service locations. Each of these offerings is governed by the terms, conditions, and policies of the underlying service provider. Website Analytics and Session Replay – We use analytics and session replay services that use cookies and other technologies that collect your Personal Information, to assist us with analyzing our Site traffic and site usage to optimize, maintain, and secure our Site and inform subsequent business decisions (including, e.g., advertising). These include, but are not limited to, the following third-party services:  

• Microsoft Clarity: We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our Site through behavioral metrics, heatmaps, and session replay to improve and market our Services. Site usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of Services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. • Google Analytics: To learn more about how Google uses data, visit Google’s Privacy Policy and Google’s page on “How Google uses data from sites or apps that use our services.” You may download the Google Analytics Opt-out Browser Add-on for each web browser you use, but this does not prevent the use of other analytics tools. To learn more about Google Analytics cookies, visit Google Analytics Cookie Usage on Websites.  
• Pixels: We use Meta and LinkedIn pixels to track user activity on our Site and improve downstream offerings, including interest-based advertising for our Services and those of our partners and service providers. 

Interest-Based Advertising – We may also allow or enable third parties to collect Personal Information to provide their interest-based advertising on behalf of our Services, or their own. Interest-based advertising occurs when advertisements are shown to you based on information collected from your online interactions over time and across multiple websites, devices, or online services that you visit or use. Some companies may engage in cross-context behavioral advertising to predict your preferences and show you advertisements that are most likely to be of interest or relevant to you.  

We do not control these third parties’ collection or use of your information for these purposes, or the opt-out options they may individually offer you via their terms, conditions, and privacy policies. If you have any questions about an advertisement or other targeted content, you should contact the applicable provider directly. Examples of the third-party service providers we engage to serve interest-based advertisements include Google Ads (including Google signals), Meta Ads (including Meta Pixels and Facebook advertising services), and LinkedIn marketing solutions (including LinkedIn Ads, Pixels, and Analytics). It is in this context that we may provide advertising networks, data analytics providers, social networks, and video sharing platforms with Personal Information such as your IP address, device information, Internet and other electronic network activity information, and geolocation information in the last twelve months. 

Selling Personal Information – While we do not sell Personal Information in exchange for monetary consideration, we do disclose Personal Information for other benefits that could be deemed a “sale” under various data protection laws because it is sometimes broadly defined to include activities such as the delivery of interest-based advertising on websites or allowing third parties to receive certain information, such as cookies, IP address, and/or browsing behavior.  

Managing Cookies 

Most web browsers allow you to manage cookie preferences through their settings, including the ability to block or delete cookies. Please note that disabling certain cookies may affect the functionality and performance of our Site. 

Where available, you may also manage your cookie preferences through the cookie consent or preference management tools provided on our Site. 

You can also block the collection and use of your information by online platforms and ad tech companies for the purpose of serving interest-based advertising by visiting the opt-out pages of the self-regulatory programs of which those companies are members: National Advertising Initiative and Digital Advertising Alliance (or the European Interactive Digital Advertising Alliance, if you are located in the European Economic Area). Please note that even if you opt out of interest-based advertising, you may still see “contextual” ads, which are based on the context of what you are looking at on the websites and pages you visit.  

You may also review and execute any provider-specific instructions to customize your preferences or opt out of certain processing, including interest-based advertising, by third-party service providers. For example, to opt out of this type of advertising by Google, customize your ad preferences, or limit Google’s collection or use of your data, visit Google’s Safety Center and Google’s Ad Settings and follow Google’s personalized ad opt-out instructions. Meta also offers an Ad Preferences center to customize your settings, as well as a Privacy Policy with additional information on how you can exercise your rights.  

Information Sharing and Disclosure 

We may share Personal Information in the following circumstances: 

Within Applied Marketing Science 

Personal Information may be accessed by authorized employees, contractors, and representatives of Applied Marketing Science who have a legitimate business need to use the information for the purposes described in this Privacy Policy. 

Service Providers 

We may share Personal Information with third-party service providers that assist us in operating our business and delivering our Services. These providers may include website hosting providers, cloud service providers, customer relationship management (CRM) platforms as previously mentioned, website analytics providers, marketing and communications platforms, event management providers, webinar providers, technical support providers, and other business support vendors. If you are applying for a job with us, this may include service providers such as recruiting platforms, background check providers, and human resource providers.  

These service providers are contractually obligated to protect Personal Information, maintain appropriate confidentiality and security measures, and use Personal Information only for the purposes of providing services on our behalf. 

Professional Advisers 

We may disclose Personal Information to our professional advisers, including legal counsel, accountants, auditors, consultants, and compliance professionals, when necessary to obtain professional services or advice. 

Legal and Regulatory Requirements 

We may disclose Personal Information when required or permitted by law, regulation, legal process, court order, governmental request, or other legal obligation. We may also disclose information when we believe such disclosure is necessary to protect our rights, property, safety, or the rights, property, or safety of others. 

Business Transactions 

In the event of a merger, acquisition, corporate reorganization, sale of assets, financing transaction, or similar business transaction, Personal Information may be disclosed or transferred as part of that transaction, subject to applicable confidentiality and legal requirements. 

Ad Tech Companies and Other Providers 

We may share or make available limited Personal Information (such as mobile device identifiers) with ad tech companies and other online service providers. When we share your Personal Information in this context, we follow applicable legal requirements, which may require that we provide opt-out rights or other individual rights. 

Other 

We may disclose Personal Information to third parties when explicitly requested by or consented to by you, or for the purposes for which you disclosed the Personal Information to us as indicated at the time and point of the disclosure (or as was obvious at the time and point of disclosure). 

Data Retention 

We retain Personal Information for as long as necessary to fulfill the purposes for which it was collected, including to support our business operations, provide requested Services and information, maintain business relationships, and comply with applicable legal, regulatory, contractual, and recordkeeping requirements. 

The length of time we retain Personal Information depends on a variety of factors, including:

• The nature of the information collected;
• The purpose for which the information was collected and is being used;
• Whether there is an ongoing business, contractual, or client relationship;
• Applicable legal, regulatory, tax, accounting, or reporting requirements; and
• The need to establish, exercise, or defend legal claims. 

Data Security 

We implement commercially reasonable administrative, technical, and organizational safeguards designed to protect Personal Information from unauthorized access, use, disclosure, alteration, or destruction. These measures are intended to help ensure the security and confidentiality of the information we collect and process. 

While we take appropriate steps to safeguard Personal Information, no method of transmitting data over the internet or storing data electronically can be guaranteed to be completely secure. Accordingly, although we strive to protect Personal Information, we cannot guarantee its absolute security. 

Your Privacy Rights 

Depending on your location and applicable law, you may have certain rights regarding your Personal Information, subject to certain exceptions, including the right to:

• Request access to the Personal Information we maintain about you; 
• Request correction of inaccurate or incomplete Personal Information; 
• Request deletion of your Personal Information;
• Object to or request restriction of certain processing activities, where permitted by law; 
• Request a copy of your Personal Information in a portable format, where applicable; 
• Withdraw consent where processing is based on consent (without affecting the lawfulness of processing before withdrawal); 
• Opt out of certain uses of Personal Information, such as targeted advertising, profiling, or the sale or sharing of Personal Information, where applicable, or to limit the use of your sensitive Personal Information. We do not collect or process sensitive Personal Information outside of purposes permitted by law (such as section 7027(m) under the California Consumer Privacy Act Regulations), so we do not offer the option to limit its use;
• Know when you are subject to automated decision-making, the Personal Information used to render the decision, the principal factors and parameters involved in the decision, and human review or correction of the decision (or its underlying data, where appropriate). You may also have the right, depending on your location, to consent or opt out of (a) this automated decision-making or (b) any profiling in furtherance of decisions that produce legal or similarly significant effects. We do not profile you or other individuals in a manner that would result in legal or similarly significant effects, or engage in automated decision-making, so we do not offer an opt out of such activity; and 
• Lodge a complaint with a supervisory authority or other applicable regulatory body if you believe your rights have been violated.  

Residents of certain U.S. states may have additional privacy rights under applicable state privacy laws. We will honor requests and provide disclosures as required by the laws that apply to your Personal Information. 

To exercise any applicable privacy rights or submit a privacy-related request, please contact us using the information provided in the Contact Us section below. You may also exercise your opt out rights by broadcasting an Opt-Out Preference Signal, such as the Global Privacy Control (GPC). We honor Opt-Out Preference Signals, including GPC. If you choose to use an Opt-Out Preference Signal, you will need to turn it on for each supported browser or browser extension you use. 

You will not be discriminated against in any way by virtue of your exercise of the rights listed in this Notice. However, should you withdraw your consent or object to processing of your Personal Information, or if you choose not to provide certain Personal Information, we may be unable to provide some, or all, of our Services to you.  

Only you, or an authorized agent that you authorize to act on your behalf, may make a request related to your Personal Information. We may need to verify your identity before fulfilling certain requests, and if we cannot verify your identity, we may request additional information from you. If you are an authorized agent making certain requests on behalf of another person, we will also need to verify your identity, which may require proof of your written authorization or evidence of power of attorney. We endeavor to respond to requests within the time period required by applicable law. If we require more time, we will inform you of the reason and extension period in writing. 

We do not charge a fee to process or respond to your requests unless they are excessive or repetitive. If we determine that a request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request. We may deny certain requests, or only fulfill some in part, as permitted or required by law. If you are not satisfied with the resolution of your request and you are afforded a right to appeal such decision, you will be notified of our appeal process in our response to your request. 

International Data Transfers 

AMS is headquartered in the United States, and the Personal Information we collect may be processed, stored, or accessed in the United States or other countries where we, our affiliates, service providers, contractors, or business partners operate. 

As a result, Personal Information may be transferred to and processed in countries that may have data protection laws different from those in your country of residence. 

Where required by applicable law, we implement appropriate safeguards for international transfers of Personal Information, which may include contractual protections, data processing agreements, or other legally recognized transfer mechanisms designed to provide an adequate level of protection for Personal Information. 

By using our Site, Services, or otherwise providing Personal Information to us, you acknowledge that your information may be transferred to and processed in accordance with this Privacy Policy.

Children’s Privacy 

Our Site, Services, and marketing activities are intended for business and professional audiences and are not directed to children under the age of 13 (or such other age as defined by applicable law). 

We do not knowingly collect, use, or disclose Personal Information from children. If we become aware that we have collected Personal Information from a child in violation of applicable law, we will take reasonable steps to delete the information as soon as practicable.

Third‑Party Websites 

Our Site and communications may contain links to third-party websites, services, or resources that are not owned or controlled by AMS. 

In some cases, we offer links to social media platforms (like X (formerly known as Twitter), LinkedIn, Instagram, and YouTube) that enable you to easily connect with us or share information on social media. Any content you post via these social media pages is subject to the terms and privacy policies of those platforms.  

This Privacy Policy applies only to information collected by AMS. We are not responsible for the privacy, security, or data handling practices of third-party websites or services. We encourage you to review the privacy policies and terms of use of any third-party sites you visit before providing any Personal Information. 

California Residents 

This section provides additional information regarding AMS’s practices pursuant to the California Consumer Privacy Act of 2018 and its implementing regulations, as amended by the California Privacy Rights Act (“CCPA”), where “Personal Information” has the definition set forth in the CCPA. 

Please see the chart below for detailed information about the categories of Personal Information we have collected from California residents during the twelve months preceding the date on which this Notice was last updated and the categories of third parties to whom we Sell or Share Personal Information (as those terms are defined in the CCPA). For each category of Personal Information set forth in the chart below, the categories of third parties to whom we disclose it for a business or commercial purpose are set forth in the Information Sharing and Disclosure section above.

California Shine the Light – Under California Civil Code Section 1798.83, individual customers who reside in California and who have an existing business relationship with us may request information about our disclosure of certain categories of Personal Information to third parties for the third parties’ direct marketing purposes, if any. To make such a request, please contact us using the contact information at the bottom of this Privacy Policy. Please be aware that not all information sharing is covered by these California privacy rights requirements and only information on covered sharing will be included in our response. This request may be made no more than once per calendar year. 

Changes to This Privacy Policy 

We may update this Privacy Policy from time to time to reflect changes in our business practices, technologies, legal requirements, or other operational needs. 

When we make changes, we will post the updated Privacy Policy on our website and revise the “Last Updated” at the top of the policy. Any changes will become effective when the updated Privacy Policy is posted unless otherwise stated.
